Security of Tenure: Security of Tenure is the protection provided to some commercial leases by the Landlord and Tenant Act 1954. If a tenancy is protected the 1954 Act allows a tenant to “hold over” after the expiry of their lease whilst still paying rent and apply for a new lease.
There are strict rules which must be adhered to when a Landlord wishes to exclude protection from the 1954 Act, terminate a tenancy or request a new tenancy. Further rules must be adhered to if a tenant wishes to request a new tenancy. Our lawyers can provide clear, straightforward advice to both landlords and tenants.
