Over the last few years there has been mention from time to time of a 'Sellers Pack'.
Whether it will ever be introduced and if so in what form still remains to be seen. The main idea of the pack is to speed up the sale and purchase of residential properties and to introduce some certainty into matters at an early stage. It may or may not achieve this, only time will tell.
In the meantime there are things that buyers and sellers can do to help both themselves and their solicitors to speed matters along.
If you are thinking of selling, don’t wait until you have a buyer for your property before involving your solicitors. Contact them when or before you put the property on the market. Your solicitors will be glad to speak to or see you at this stage for an initial chat and in most cases without charge (this Firm certainly don’t make a charge for this meeting). The first thing we would do would be to give you an estimate of our charges. We will also establish where your deeds are so we can obtain them. We can also supply you with a Sellers Property Information Form and a Fixtures Fittings and Contents Form for completion. The Information Form helps you to gather together certain basic information with regard to the property. Amongst other things, it will remind you to look out any Planning or Building Regulations paperwork in respect of any alterations or extensions carried out to the property, as well as any guarantees and information you may have relating to any other work carried out, such as replacement windows, damp proofing etc.
Once your sale is confirmed, the Property Information Form and the Fixtures Fittings and Contents Form will be sent to the buyers solicitors with details of the Title to the property, with a view to supplying them with as much information as possible at the outset of the sale. This should help reduce any additional questions which they may feel it necessary to raise about the property.
If you are thinking of buying, see us before or while you are looking for a property. We can again give you an estimate of our charges and any disbursements to be paid such as search fees, Land Transfer Tax (formerly known as stamp duty) etc. We can also give you details of local surveyors, mortgage brokers and other professionals whose services you may require.
If you have not used a Solicitor before or are intending to change solicitors there is one other important matter that can be dealt with at an early stage to save time later. To comply with the Government’s Money Laundering Regulations, Solicitors are now required to obtain from a new client evidence of identity and residential address before acting for them.
Please don’t forget that the person you see and speak to at your local solicitors should have considerable knowledge of the area and he or she will have handled many property transactions over the years. I, for example have successfully carried out many sales and purchases in (and out) of the area over the last 26 years. This means I know the Estate Agents, Surveyors, Mortgage Brokers, Independent Financial Advisers and other professionals whose help you may require and can give you advice in this respect. Sometimes it is a case of horses for courses, therefore who you use can be important.
