Article - Moving Home: Selling & Purchasing a Property (31/08/2007)

How do they do that?
 
All of our conveyancing lawyers are very experienced and will guide you from the start.
 
You can contact us at any time to discuss any problems which may arise.
 
We will deal with other solicitors, estate agents and your bank or building society on your behalf.
 
We will discuss the advisability of surveys or other professional advice.
 
What do I have to do?
 
As soon as you have decided to move – come and see us.  Do this even if you have not yet put your property on the market or found somewhere else to buy.
 
If you are selling – ask your present Bank or Building Society to tell you how much you owe on your present mortgage, this will help you work out the “equity” which you have in your house.
 
If you are buying – decide whether you will need a mortgage.  If so contact a mortgage lender to get an idea of how much you can borrow.
 
If you have special requirements regarding the timing of your move – tell us and your estate agents as soon as possible.
 
Keep in touch with us and your selling estate agents regarding progress.
 
How much will it cost?
 
We are happy to give you an estimate of our charges and the other expenses involved in the conveyancing process on request and without obligation.
 
What is the procedure?
 
When you instruct us to act for you in your conveyance we will send you a Confirmation of Instructions form to sign together with a Client Care Letter.  These give you written confirmation of our terms of business, the costs involved and details of the service we will give you.
 
In normal cases, the charges and expenses will not exceed the estimate.  However, if sums payable to others, such as the local authority or government change, or if the transaction is more time consuming than expected, we will contact you immediately to explain and discuss any possible increase in cost.
 
When do I have to Pay?
 
If you are buying a property, we will ask you for a payment on account to cover initial search fees.  These will be itemised in an estimate.
 
In all cases we must have sufficient monies to cover our charges and all the costs of the sale and/or purchase in time for completion.

A Useful Guide to Words Found in Conveyancing
 
 
LOCAL SEARCHES – These are enquiries which we make with local authorities and others to find out anything which might affect the property you want to buy and which might affect your decision to buy.
 
PRE-CONTRACT ENQUIRIES – The Sellers of a property and their solicitors reply to these to give information which supplements that given in response to local searches.
 
EXCHANGE OF CONTRACTS – This is when you become legally bound to go ahead with your sale and/or purchase.  Up to this point you can withdraw; after exchange you cannot!  At exchange of contracts you agree a completion date.
 
COMPLETION DATE – This is the date when your sale or purchase is completed and you move into your new home.
 
EQUITY – This is the difference between the sale price of your home and the total of the amount owing on any mortgage.
